What Needs to Be Known about Property Law? Interview with Fairouz Nagia-Luddy

Different areas of law can be difficult at times to understand without a law degree or someone to explain it to you. Property law for example is a subsection that can be confusing and discriminatory to underprivileged groups. In general, property law is the area that governs forms of ownership within personal assets and property. South African property law focuses on aligning individual interests in property, ensuring the protection of rights when involving property and the looking over of proprietary relationships.


Fairouz Nagia-Luddy talked to us about this topic. Fairouz is an advocate of the High Court of South Africa since 2013. She has a passion for social justice in which she conducted a litigation and motion court practice as a member of the Cape Bar until 2016. She practices as an independent legal practitioner currently with the WC State Law Services in 2022. She has degrees from both Western Cape and the University of Cape Town with special interests in constitutional and human rights law, the law of contract, international human rights and humanitarian law. She also hosts regular global-political and current affairs programmes on community radio. 

In our conversation Fairouz spoke about the differences between real property, personal property, what people need to be aware of when buying property, and the legal steps needed to transfer property. She made sure to explain the discrimination and violation of rights attached to property issues, the importance of paying those taxes, and all of the resources and people you can go to in order to assist you.
